Complaints against retailers, merchants, and other providers of goods and services can arise for a variety of reasons. A customer may feel that she was overcharged on her cable bill, for example, while another customer may believe that a car dealership misled him about the quality and specifications of a new vehicle. Complaints can range from being dissatisfied with the level of customer service received to outright fraud. While it is usually a good idea to try to resolve a complaint by first speaking directly with the company, such as by calling or emailing them, if the issue does not get resolved then writing a complaint letter could help. Here are the legal benefits of writing a complaint letter and how to do so.

Legal protection

Writing a complaint letter is a serious step. It shows the company that you are very dissatisfied with how they have handled your concern and that you are now willing to put those concerns down on paper. By putting your complaint in writing you are creating a written record of the complaint. Having a written record of the complaint could provide you with legal protection in the future. For example, if the issue escalates to small claims court then having written proof of the complaint could show that you took reasonable steps to have the issue resolved, which then went unaddressed by the company. Simply complaining to a company in person or over the phone provides less verifiable evidence that you tried to resolve your complaint in a reasonable manner.

Writing an effective complaint letter

To enjoy the ful legal protection that a complaint letter may provide, however, you need to write your own letter with care. Your letter should be clear about what the problem is and what you expect to be done to remedy it. Include whatever information may be relevant to resolving your complaint, such as serial numbers, the address of the business, and the names of individuals at the business you previously spoke to. You should also provide copies of receipts and warrants, if necessary. Give a firm deadline of when you expect the company to take action. Finally, do not write a letter that could be perceived as threatening, harassing, or sarcastic in any way as such a letter may only harm your case later on.

Consumers have a number of rights when dealing with sellers and writing a complaint letter is just one tool that consumers can use to uphold those rights. By writing an effective complaint letter, consumers help protect themselves legally and stand a better chance of having their issue remedied faster.

"Dear Lewisham PALs [patient, advice and liaison service],

I would like to complain about a visit I had to your A&E department on Monday the 15th of June 2015. Sorry in advance for my language, but this really upset me.

On Monday the 15th of June I fell and knew I broke something (turns out I broke my elbow) so I went to Lewisham A&E.

I came armed with a book to help me pass the waiting time! Actually enjoying the fact that I am going to get to read a book for a chance!

But no… the bloody nurse sees me in six minutes! Six ruddy minutes! All I had time for was to send a text, settle down, get my glasses out and find the right page, and they bloody call me in!

She then sends me to have an X-ray and says I need to sit in the X-ray waiting room. Yay, I think, a waiting room – I will get to read my book!

And so I don’t even bother to put anything back in the bag and happily skip to the X-ray waiting area, book in hand and glasses on top of head. I sit down and get seen within 37 seconds. The ba***rds.

All done and dusted and five minutes later I skip to the next waiting area to wait for the next nurse to see me.

By that point I think I owe myself a chocolate from the vending machine but waste five minutes trying to make it work (it didn’t – at least there is one thing you can count on in this A&E!). I then sit down comfortably, happy in the notion that surly, now… I will get at least a couple of chapters… but no!

Two minutes later I get to see the next nurse who is an absolute gem and is super nice, she explains everything, gives me a sling, and a tetanus shot and sends me on my way home! Home! Bloody rubbish!

I left home and came back in less than two hours! Seriously! Something must be done about this! What is a mum to do in order to get a few hours of quiet reading in this country???!!!

For customers looking to express their dissatisfaction with the quality of service at a supermarket or shop, penning a strongly worded letter has long been the first resort.

Now, many shoppers are tweeting at brands making their dissatisfaction known for all the world to see. 

And for every company that will send a conservative note back, or reply with a prompt apology there are those that like to add a certain artistic or comic flair to their customer interactions.

Tesco certainly put a lot of time and effort into their response to this customer, composing a very impressive poem and even attaching a gift card

While most of the exchanges take place on social media, it seems some still like to approach things the old-fashioned way. 

One member of the public felt so strongly about the fact that Tesco had run out of their favourite popcorn at their local store that they wrote a letter to Sir Richard Broadbent, the chairman of Tesco. 

Not only did they take the time to compose a letter, they also included a personal poem for Tesco about their 'bereavement' over the issue. 

Tesco took the matter equally as seriously as the customer and wrote a letter back that even included a very impressive poem with lines including, 'a decision was taken though not in great haste, to de-list this item 'cos it ended in waste'.

They also added a £10 giftcard. 

Tom Dodds was impressed with the 'gourmet level banter' he received from Pret A Manger's social media team in response to his crayfish complaint

They're not the only ones to show they can handle complaints with a sense of humour. 

Both Pret A Manger and Argos have impressed customers with their entertaining responses to complaints.

After what Tom Dodds described as a 'crayfish issue' at Pret, he tweeted out their hilarious responses where they engaged in using fish puns in the lyrics of popular songs.

A clearly amused Tom described the exchange as 'gourmet level banter'. 

Twitter user Immy 'BADMAN' Bugti appeared impressed by the response he received from Argos

A frustrated Immy 'BADMAN' Bugti had tweeted Argos saying: 'YO when u gettin da ps4 tings in moss side? Ain't waitin no more. Plus da asian guy whu works dere got bare atttitude #wasteman'

Taking it in their stride, Argos replied to Immy in an equally informal manner, saying: 'Safe badman, we getting sum more PS4 tings in wivin da next week y'get me. Soz bout da attitude, probz avin a bad day yo.' 

A satisfied Immy then tweeted: 'Respect. Sick guy.'

The customer definitely was not right in this situation, but at least Twitter user SadderDre was happy to admit his mistake

But a customer blunder took place when a Twitter user tweeted Domino's Pizza saying: 'Yoooo I ordered a Pizza & Came with no Toppings on it or anything, Its Just Bread'.

Domino's responded quickly to the matter saying they were sorry to hear about the problem and to let them help. 

Embarrassingly, the person tweeted them back saying: 'Never mind, I opened the pizza upside down'.

It turns out then, that the customer isn't always right.

And some cheeky customers even try to troll companies with their complaints.

Just this week, Leila Jayne Daly contacted Sainsbury's with her saga of what happened when she allegedly found a worm in her lettuce.

It apparently led to her gaining 12 stone and working as a prostitute.

Luckily, Sainsbury's customer service team were well able to deal with Leila's elaborate complaint.

They instead joined in on the joke and even offered Leila a refund along with 'a little extra' to treat herself and feed the offending worm.

Another cheeky customer tweeted Tesco to tell them that they had a problem with one of the products they had recently purchased.

When Tesco's customer service team replied asking what the problem was, he tweeted back a picture of a dog - whose hair was a bright colour - and said: 'Yes why on earth has your shampoo turned my dog pink?'

It turns out that some companies can be incredibly sassy in their responses to customers.

Felipe tweeted: 'Immediate turn off if a girl's mobile network is tesco mobile'.

They hadn't even tagged the brand in their tweet but Tesco Mobile saw it and replied sarcastically, saying: 'Are you really in a position to be turning girls away?'  

Tesco weren't letting Felipe away with this comment

Customer James Rhodes once tweeted O2 with a query: 'Hey @o2 - please get your SMS working! I sent this girl 246 texts last night asking her out and none of her replies have come through yet...'

O2 had the perfect response.

They simply said: 'Hi James, that's a lot of texts! Maybe next time you should try sending 1 text to 246 different girls...' 

The customer service department at O2 had some very good advice for James Rhodes

These hilarious exchanges between companies and members of the public have often gone viral due the company's sense of humour when responding. 

They've made companies appear far more accessible and lightened the mood of angry customers.
