The beginning of every year is a time when many people begin looking for new jobs or even changing jobs. For foreigners in China, changing jobs also means changing or updating work permits and work visas.

Based on the current work permit policies, these are the steps you need to follow if you are looking to change jobs:

1. Cancel the previous work permit

    1-2 weeks

2. Apply for a new work permit

    2-3 weeks

3. Apply for a new work visa

   7 working days

Cancelling your previous work permit is the first and most important step. Since now all cities in China are using the same work permit system, it doesn’t matter if you wish to change to a different job in your current city or another, you still need to cancel your current permit before you apply for a new one.

How to cancel your current work permit?

The work permit cancellation needs to be applied through the work permit system by your previous employer and it takes 6-10 working days to process, so if you want to change jobs, it’s best you ask your previous employer to apply for the cancellation as early as possible, in which case, the following documents need to be prepared:

1. An application form from the system signed by both the applicant and employer, stamped by the company stamp.

2. A release letter which needs to be signed by the applicant and the employer, stamped by the company stamp

(a template can be downloaded at VisaOfChina’s official WeChat)

3. Your original work permit

4. Your work permit’s scan information

(found by scanning the QR Code)

To make sure there are no disputes between employee and employer, all papers need to be signed by both parties (signature and stamp) and need to be submitted to the bureau. If you are planning on changing jobs anytime soon, it is important to keep a cordial relationship with your former employer, as it might affect your application process or you might not be able to apply at all.

Once all the steps have been completed and your permit cancellation has been successful, you will receive a cancellation letter issued by the work permit bureau.

With the cancellation letter, you can start the application to apply for a new work permit with your new employer. These are the documents you need to prepare:

1. Original passport with copies

(first page, current visa page, last entry page)

2. Applicant's Resume

(it needs to be continuous after graduation and have at least 2 years relevant working experience)

3. Working reference letter from any former employers

(with more than 2 years relevant experience)

4. Non-criminal Record Report, needs to be legalized by your country’s Chinese Embassy or your country’s Consulate in China

(You can be exempted from this step if you apply on time)

5. Applicant's original diploma, needs to be legalized by your country’s Chinese Embassy or your country’s Consulate in China

(You can be exempted from this step if these documents have been submitted before)

7. Applicant's Medical Report

Please visit these website to make an appointment: sithc.chinaport-sh.com.cn)

(You can be exempted from this step if you apply on time)

Visa Guidelines

Visa Background Information

Because of the number of visa applications and the need for thorough security reviews, the visa application process can take several months. It is strongly encouraged travelers to apply for their visas as early as possible (at least 3 to 4 months before the visa is needed).

Contact the nearest U.S. consulate or embassy for details on visa application procedures.

Guidelines for Successful Visa Applications:

  • Visa applicants are expected to provide evidence that they are intending to return to their country of residence. This may include documentation of the following:
    • family ties in home country or country of legal permanent residence
    • property ownership
    • bank accounts
    • employment contract or statement from employer stating that the position will continue when the employee returns
  • Visa applications are more likely to be successful if completed in a visitor's home country than in another country
  • Applicants should present their entire trip itinerary, including travel to any countries other than the United States, at the time of their visa application
  • Include a letter of invitation from the meeting organizer or the U.S. host, specifying the subject, location and dates of the activity, and how travel and local expenses will be covered
  • If travel plans will depend on early approval of the visa application, specify this at the time of the application
  • Provide proof of professional scientific and/or educational status (students should provide a university transcript)
  • Any evidence that establishes a prior record of business travel to exhibitions and other events is helpful. A photograph of an applicant staffing an exhibit booth, receipts for admission, purchases of goods and services to support an exhibit booth at an event, are all potentially valuable evidence that may tip the balance in favor of visa approval.

Information to Take to the Interview:

  • Evidence of prior related business travel, even travel to countries other than the United States (US).
  • A business resume written in English.
  • A letter of invitation containing anti-counterfeit measures from the sponsoring organization, such as SPIE, as well as personal information about the applicant such as a passport number, Paper Number, etc.

Even those who have traveled frequently to the US for business purposes might encounter difficulties from time to time that might have little to do with their standing as individuals. The nature of the products and/or industry in which they have become involved such as certain types of US controlled goods (wireless technology, electronics, and such) may give rise to difficulties and/or delays. The political climate and current state of relations between the nations may become a factor. In other words, a prior history of travel to the US is never a guarantee of future admission.

Visa Difficulties

SPIE does not have any influence with the State Department or the Office of Homeland Security. If your visa is delayed (60 days or longer) or denied, please contact the consulate where your application is being processed. Also, please contact the National Academies' International Visitors Office and fill out the questionnaire:

http://sites.nationalacademies.org/pga/biso/visas/pga_048017

The International Visitors office regularly reports to the State Department (submitted through the Visa Questionnaire) about applications which have been pending for longer than 60 days.

Our proactive approach

Some California criminal defense lawyers take a wait-and-see approach. They stall until the first court date, or until they receive the police reports, before investigating and working up your case. By contrast, we believe there's no time to waste, especially for international students and exchange visitors.

The most critical window for defense may be the first few days following an arrest, or even prior to formal charges being filed.

By getting to work immediately, often we can locate favorable defense evidence and witnesses, and get a head start towards defeating charges.

Stop charged before they are filed?

Sometimes it's possible for our Santa Monica criminal defense lawyer to stop criminal charges from being filed. After making an arrest or investigating a suspected crime, police take their evidence to the district attorney.

The D.A. evaluates the potential case and decides what, if any, criminal charges to file. Usually, the prosecutor makes this decision based solely on what police present. But often there's much more to the story.

Often our criminal defense lawyers can also meet with the D.A. during this same time period to present our evidence and witness statements.

Knowing your side of the story may affect the D.A.'s calculations and help prevent F1 students deported. When the prosecutors see the whole picture, not just what the police or alleged "victim" have to say, they may decide to file lesser charges such as a misdemeanor rather than a felony, for example. Or perhaps even reject the case and not file any criminal charges at all.

An apology letter for cancellations is a communication that is used to relay information about cancelling an event, order, subscription or contract. The document.
